General Terms and Conditions Hosting4Webshops – Jevy Web Development
Definitions
1.1. In these general terms and conditions the following definitions apply:
a. “Hosting4Webshops”: Hosting4Webshops, part of Jevy Web Development, located in Zwaarkdijk-Oost, Tomatenmarkt 44A-1681PH, registered with the Chamber of Commerce under number 54353661;
b. “Customer”: the natural or legal person who enters into an agreement with Hosting4Webshops for the use of hosting services and/or the registration of domain names;
c. “Agreement”: the agreement between Hosting4Webshops and the Customer with regard to the hosting services and/or the registration of domain names;
d. “Services”: the hosting services and the registration of domain names that Hosting4Webshops offers to the Customer;
e. “Website”: the website of Hosting4Webshops, which can be found at http://www.hosting4webshops.nl.
Applicability
2.1. These general terms and conditions apply to all offers, quotations, and agreements between Hosting4Webshops and the Customer, unless otherwise agreed in writing.
2.2. Deviations from these general terms and conditions are only valid if they have been expressly agreed in writing between Hosting4Webshops and the Customer.
Offers and Quotations
3.1. All offers and quotations from Hosting4Webshops are without obligation unless expressly stated otherwise.
3.2. Hosting4Webshops is not bound by apparent errors or mistakes in its offers or quotations.
Realization of the agreement
4.1. The Agreement is concluded when the Customer places an order via the Hosting4Webshops Website and Hosting4Webshops has confirmed this order.
4.2. Hosting4Webshops reserves the right to refuse an order or to impose additional conditions on the conclusion of the Agreement.
Duration and Termination
5.1. The Agreement is entered into for the duration stated in the Customer’s order.
5.2. Hosting4Webshops has the right to terminate the Agreement with immediate effect and without prior notice if the Customer acts contrary to these general terms and conditions or the law.
Rates and Payment
6.1. The rates for the Services of Hosting4Webshops are stated on the Website and are exclusive of VAT unless stated otherwise.
6.2. Payment must be made within the term stated on the Hosting4Webshops invoice.
6.3. In the event of late payment, the Customer is legally in default and Hosting4Webshops is entitled to charge the statutory interest and collection costs.
Liability
7.1. Hosting4Webshops is not liable for any direct or indirect damage to the Customer or third parties unless there is intent or gross negligence on the part of Hosting4Webshops.
7.2. Hosting4Webshops’ liability is at all times limited to the amount covered by Hosting4Webshops’ liability insurance.
Force measure
8.1. Hosting4Webshops is not obliged to fulfill any obligation if it is prevented from doing so as a result of a circumstance that is not its fault.
8.2. Force majeure includes, among other things: strikes, illness of staff, government measures, disruptions in internet connections, and other technical disruptions.
Complaints
9.1. Complaints about the Services of Hosting4Webshops must be reported in writing to Hosting4Webshops as soon as possible, but no later than 14 days after discovery.
9.2. Hosting4Webshops will handle complaints as soon as possible and resolve them to the best of its ability.
Governing Law and Disputes
10.1. Dutch law applies to all agreements between Hosting4Webshops and the Customer.
10.2. Disputes between Hosting4Webshops and the Customer will be submitted to the competent court in the district where Hosting4Webshops is located.
Amendments
11.1. Hosting4Webshops reserves the right to unilaterally change or supplement these general terms and conditions.
11.2. Changes to these general terms and conditions will take effect after they have been communicated to the Customer in writing.
By placing an order with Hosting4Webshops, the Customer agrees to these general terms and conditions.
